- Who is exempt from overtime pay under the FLSA?
- Employees who meet both a salary test and a duties test under one of the FLSA's named exemption categories. The primary categories are executive, administrative, professional (learned and creative), outside sales, and computer employee. Each has specific criteria defined by the DOL under 29 CFR Part 541. If an employee fails either the salary test or the duties test, they are nonexempt and entitled to overtime at one and one-half times their regular rate for hours worked beyond 40 in a workweek.
