2. Score Each State Against Compliance KPIs
Prerequisites
- Defined OT compliance KPIs: OT hours as percentage of total hours, premium variance vs. prior period, exception-resolution rate, states-with-open-alerts count
- Monthly compliance data from the previous step
For each state in the exposure map, calculate OT hours as a percentage of total hours and compare to the prior month's baseline. Flag states where the OT percentage increased by more than 20% for investigation.
Additional KPIs to score:
- Premium cost per employee: Total OT premium dollars divided by headcount in that state. A rising cost per employee without a corresponding schedule change may indicate a rule-set issue.
- Daily vs. weekly OT ratio: In daily-OT states, track the split between daily and weekly OT hours. A sudden shift in ratio can signal a configuration change or a scheduling pattern that warrants attention.
Record the scores in the Overtime Compliance Scorecard alongside the prior month's values for trend analysis. Trends matter more than absolute values; a consistently rising OT percentage in a high-severity state warrants action even if each month's increase is small.

3. Audit Exception-Resolution Rate
Prerequisites
- Exception logs from each pay period in the prior month
Calculate the percentage of time-record exceptions (missing punches, unapproved OT, location-state mismatches) that were resolved before payroll close during the prior month. Target a resolution rate of 95% or higher. A rate below 90% triggers a process review.
Unresolved exceptions that carry over into payroll create two risks: incorrect pay and weak audit records. Track the exception-resolution rate as a leading indicator of compliance health. If the rate is declining, investigate root causes. Common drivers include supervisor non-response to alerts, field workers failing to correct missing punches before the approval deadline, and system-generated false positives that train supervisors to ignore alerts.
Document the rate and any remediation actions in the scorecard.
Expected outcome: The exception-resolution rate is calculated, documented, and compared to the 95% target, with root-cause investigation initiated if below 90%
4. Check for State-Law Updates
Prerequisites
- Access to state labor department bulletin subscriptions or a verified regulatory tracking service
- Current rule-set version documentation from Procedure 2
On a quarterly basis, review state labor department bulletins, regulatory updates, and legislative summaries for every state in your exposure map. Compare current published rules against the rule-set version documented in Procedure 2.
Focus on:
- Changes to daily or weekly OT thresholds
- New daily-OT or double-time requirements enacted by states that previously followed federal-only rules
- Changes to salary thresholds for overtime exemptions that could reclassify exempt employees as non-exempt
- Updates to workweek averaging provisions (e.g., changes to Maine's biweekly cap eligibility)
If any rule has changed, initiate a Procedure 2 reconfiguration for the affected state before the next pay period in which the new rule takes effect. Do not wait for the quarterly review cycle to catch changes that have already taken effect; subscribe to state labor department email alerts for real-time notification.
Expected outcome: All state OT rules in the exposure map are confirmed current, and any changes are flagged for Procedure 2 reconfiguration with a named owner and deadline
5. Produce the Overtime Compliance Scorecard
Prerequisites
- Completed KPI scoring, exception audit, and law-change check from prior steps
Compile KPI results, state-level flags, exception-resolution rate, and any law-change findings into a one-page Overtime Compliance Scorecard for HR and Finance leadership. The scorecard should present:
1. Summary status: green (all KPIs within target), yellow (one or more KPIs trending toward threshold), or red (one or more KPIs breached).
2. State-by-state KPI table with month-over-month trend indicators.
3. Exception-resolution rate with target comparison.
4. Law-change findings and reconfiguration status.
5. Open findings from prior scorecards with remediation status.

Examples of remediation actions:
- A state with a rising OT percentage: assigned to the scheduling lead to review shift patterns and identify the driver.
- An exception-resolution rate below target: assigned to the operations manager to investigate supervisor alert response times.
- A state-law change requiring reconfiguration: assigned to the payroll systems lead to execute Procedure 2 for the affected state.
Do not publish a scorecard with open findings that lack a named owner. Unassigned findings decay into unresolved liability. The compliance owner reviews the prior month's assignments at the start of each cycle and marks them as resolved, in progress, or escalated.
Expected outcome: Every open finding has a named owner, a specific remediation action, and a due date, with tracking documented in the scorecard for follow-up
